Since the NJ State Dept. ignores our emails, use the State OPRA Request Portal to re-send our April 20th CTA.
- Go to: https://www-njlib.nj.gov/NJ_OPRA/department.jsp
- Select “State” and then select “Office of the Secretary of State.”
- Complete the required fields (shaded in blue) on the Requestor Form, then copy/paste the following words into the “Record Request Information” box (shaded in blue) at the bottom of the form.
- Click the “Submit” button.
Pursuant to OPRA N.J.S.A. 47:1A-1 et seq. and New Jersey Sunshine Law, I am requesting access to and copies of the Memorandum of Understanding (MOU) between your office and the Department of Homeland Security (DHS) and any MOU between your office and the Federal Bureau of Investigation (FBI).
Specifically, include documents that detail the following aspects of these agreements:
- Nature and Scope of the Agreements: Any information regarding the specific purposes, objectives, and scope of the agreements, including but not limited to terms and conditions agreed upon.
- Personal Identifiable Information (PII): Any details about the sharing and access of personally identifiable information (PII) under these agreements. Please
include information on what types of Pll are shared, how this information is protected, and the protocols for access and use by each party. - Software Sharing: Information regarding any software, technology, or systems shared or jointly accessed as part of the agreements. This includes any software provided by your office to these agencies or vice versa, as well as details about the use and security of such software.
- JURY POOL DATABASE: Please provide any agreements with state and federal courts within your jurisdiction that pull PII and CENSUS materials. Also, provide the agreements.
Please include any related records, emails, attachments, or correspondence between the New Jersey Secretary of State’s office and the mentioned agencies regarding the above points.
If access to the records I am requesting will be delayed, please let me know why and when I might expect copies of the requested documents.
If you deny any or all of this request, please cite each specific exemption you feel justifies the refusal to release the information and notify me of the appeal procedures available under the law. If your department is not the custodian of these documents please advise in writing who is and kindly forward this lawful OPRA request to that custodian.
